Terms and conditions
Definitions
Canna Doctor: the party offering products and services under these terms and conditions.
Customer: the person with whom Canna Doctor has agreed.
Parties: Canna Doctor and Customer collectively.
Consumer: a Customer who is also an individual and acts as a private person.
Applicability of General Terms and Conditions
These terms and conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of Canna Doctor.
Parties can only deviate from these conditions if they have expressly and in writing agreed to do so.
Parties explicitly exclude the applicability of any additional or deviating general terms and conditions of the Customer or third parties.
Prices
All prices maintained by Canna Doctor are in euros, include VAT, and exclude additional costs such as administrative fees, levies, and travel, shipping, or transportation costs, unless expressly stated otherwise or agreed upon differently.
Canna Doctor reserves the right to change all prices for its products or services, whether on its website or otherwise disclosed, at any time.
Increases in the costs of products or components that Canna Doctor could not have foreseen when making the offer or concluding the agreement may lead to price increases.
The Consumer has the right to terminate an agreement due to a price increase unless the increase results from a legal regulation.
Samples/Models
If the Customer has received a sample or model of a product, they cannot derive any rights from it other than that it indicates the nature of the product, unless expressly agreed otherwise.
Consequences of Late Payment
If the Customer does not pay within the agreed-upon term, Canna Doctor is entitled to charge an interest of 1% per month from the day the Customer defaults.
When the Customer defaults, they must also pay Canna Doctor extrajudicial collection costs and any potential damages.
The collection costs will be calculated according to the applicable legal regulation.
Canna Doctor may suspend its obligations until the Customer has fulfilled their payment obligations.
In the event of liquidation, bankruptcy, seizure, or suspension of payment on the part of the Customer, Canna Doctor’s claims become immediately due and payable.
If the Customer refuses to cooperate, they are still obliged to pay the agreed price.
Right of Reclamation
Canna Doctor may invoke the right of reclamation on unpaid products.
This is done via written or electronic communication.
The Customer must immediately return the products unless otherwise agreed.
The Customer bears the return costs.
Right of Withdrawal
Consumers have a 14-day right of withdrawal, provided:
- The product has not been used.
- It is not perishable, customised, hygienically restricted, or a digital data carrier with a broken seal.
- It is not a ticket, a service already used, a leisure activity, or a single magazine/newspaper.
The cooling-off period starts:
- The day after receiving the last product.
- Upon first delivery of a subscription.
- Upon first use of a service.
- Upon confirmation of receipt of digital content.
Withdrawal must be communicated via info@canna-doctor.com, optionally using the withdrawal form from http://cannadoctor.com.
The Consumer must return the product within 14 days.
Return costs are borne by Canna Doctor only if the entire order is returned.
Reimbursement will occur within 14 days if the product is returned on time.
Right of Suspension
Unless the Customer is a Consumer, they waive the right to suspend performance.
Right of Retention
Canna Doctor may retain products until outstanding invoices are paid.
This also applies to prior agreements.
Canna Doctor is not liable for any resulting damages.
Set-Off
Unless the Customer is a Consumer, they waive the right to set off debts against claims.
Retention of Title
Canna Doctor remains the owner of all products until full payment is made.
Until then, products may not be pledged, sold, or encumbered.
If retention is invoked, the agreement is terminated, and Canna Doctor may claim damages.
Delivery
Subject to availability.
Takes place at Canna Doctor’s premises unless agreed otherwise.
Online orders are delivered to the address provided by the Customer.
Obligations may be suspended if payment is not made.
Late payment results in default, precluding delay claims.
Delivery Time
Indicative only.
No rights to termination or compensation unless agreed otherwise in writing.
Starts upon full order completion and confirmation.
Exceeding the delivery time does not entitle the Customer to compensation or termination unless delivery fails after 14 days of written notice.
Actual Delivery
The Customer must ensure timely acceptance of delivery.
Transport Costs
Borne by the Customer unless agreed otherwise.
Packaging and Shipping
Damaged packaging must be noted with the carrier.
Self-arranged transport requires a prior damage report.
Failure to report voids liability.
Storage
Delayed acceptance is at the Customer’s risk and cost.
Warranty
Applies only to defects from manufacturing, construction, or materials.
Excludes wear and tear, accidents, modifications, negligence, or unclear causes.
Risk passes to the Customer upon delivery.
Exchange
Allowed only if:
- Within 14 days of the original invoice.
- In original packaging with tags.
- Unused.
Discounted, perishable, customised items cannot be exchanged.
Indemnification
The Customer indemnifies Canna Doctor against third-party claims related to provided products or services.
Complaints
Must be reported as soon as possible after discovery, within 1 month for general Customers and 2 months for Consumers.
It must be described in detail and shown to relate to the agreement.
Ongoing services are not grounds for additional obligations.
Notice of Default
Must be communicated in writing.
Responsibility lies with the Customer to ensure delivery of notice.
Joint and Several Liability
Multiple Customers are jointly and severally liable.
Liability of Canna Doctor
Only for intent or gross negligence.
Limited to direct damages and any amount paid under insurance.
Otherwise, limited to the invoice amount.
Indicative imagery cannot form the basis for compensation or termination.
Expiration Period
Claims expire 12 months after the liability-triggering event.
Right to Termination
The customer may terminate if Canna Doctor is culpably in default and not of minor importance.
Canna Doctor may terminate if obligations are not fulfilled or cannot be expected to be fulfilled.
Force Majeure
Includes all beyond-control situations such as war, strikes, internet failures, natural disasters, etc.
Suspends obligations during force majeure.
If lasting over 30 days, either party may terminate the agreement.
No compensation owed.
Amendment of the Agreement
Agreements may be amended through mutual consultation.
Amendment of General Terms and Conditions
Canna Doctor may amend these at any time.
Minor changes may be made without consultation.
Substantial changes will be discussed with the Customer.
Consumers may terminate the agreement in such cases.
Assignment of Rights
Customer rights may not be transferred without prior written consent from Canna Doctor.
Invalidity or Voidability
The remaining provisions remain in effect if a provision is invalid or voidable.
An invalid provision will be replaced with one that best reflects the original intent.
Applicable Law and Jurisdiction
Dutch law applies exclusively.
Unless the law provides otherwise, disputes will be submitted to the court in the district where Canna Doctor is established.
